General Terms and Conditions

These General Terms and Conditions ("terms") apply to all orders of Monfortelli from patriterra Mader (hereinafter "we"), whether you place them via the contact form on www.monfortelli.ch, by email or by phone. The version we send you with the offer applies to your order.

We sell to private individuals and to companies in Switzerland. The rules in section 10 also apply to companies. If our offer provides otherwise than these terms, the offer prevails.

We deliver exclusively to addresses in Switzerland. If you live abroad, including in Liechtenstein, you can order to a delivery address in Switzerland.

1. Send an enquiry: Write to us at pm@patriterra.ch or use the contact form, telling us how many packs you would like, your billing and delivery address and your phone number. If you would like to give Monfortelli as a gift, give us the address of the recipient. We need the phone number in case we have questions about the delivery.
2. Receive an offer: We send you a written offer with the price, shipping costs, total amount and estimated delivery time, together with these terms.
3. Confirm: You confirm the offer by email. This concludes the purchase contract.
4. Pay and enjoy: You pay as described in section 6, and we send you your Monfortelli.

The prices on the website are not yet a binding offer. Our offer is valid for 10 days, while stocks last. Monfortelli are made by hand in small quantities, and our stock is limited. If we are nevertheless unable to deliver after your confirmation, we will inform you immediately and refund any amounts already paid in full.

Monfortelli are sweet dark chocolate truffles with hazelnut pieces from Piedmont, made by VIALANGHE s.r.l. They are mixed, rolled and cut by hand. We sell them in 200 g packs. Other sizes by arrangement.

Monfortelli are a seasonal product. We sell them roughly from October to January, while stocks last. If you would like Monfortelli for Christmas, please pre-order them by the end of October.

You can find the ingredients, allergens, net weight, origin and shelf life on our website. The information on the packaging is authoritative.

Because the truffles are handmade, the shape and size of individual pieces may vary slightly, and the images may not show the packaging in every detail. This is not a defect.

All prices are in Swiss francs and include VAT. The price in our offer applies.

The value of the goods per delivery address is decisive. If you have orders delivered to several addresses, we calculate each address separately. The shipping costs are stated in our offer.

You pay in advance, whether as a private individual or as a company. Once you have confirmed our offer, we send you an invoice with a QR code. Please pay it within 10 days by e-banking or banking app. As soon as the money has reached us, we send off your Monfortelli. If no payment has been received after 10 days, the order lapses.

We ship your order with Swiss Post as soon as your payment has been received. Delivery usually takes 3 to 5 working days. Delivery times are estimates. If a delivery is delayed, we will get in touch with you.

If the goods have still not reached you more than 2 weeks after the stated delivery time, you can withdraw from the purchase and receive a full refund.

If you need the Monfortelli by a specific date, for example before Christmas or for a company event, please order in good time. A fixed delivery date only applies if we have confirmed it to you in writing.

If a parcel is lost on its way to you, we will send you the goods again free of charge. If they are no longer available, we will refund the purchase price.

If a parcel is returned to us because the address was wrong, delivery was refused or the parcel was not collected within Swiss Post's collection period, we will send it to you again, provided the goods are still in perfect condition. We may charge you the additional shipping costs. In this case we cannot refund the purchase price, because we cannot resell returned food.

If a delivery cannot be made on time due to force majeure, such as natural events, strikes or disruptions at the manufacturer or at Swiss Post, the deadline is extended by that period. If the disruption lasts longer than 30 days, either party may withdraw from the contract; we will refund in full anything already paid.

Monfortelli are food. For reasons of food safety and hygiene, we cannot take them back, not even unopened. In Switzerland there is no statutory right of withdrawal for orders placed by email or online. If you have questions about ingredients or allergens, we will be happy to advise you before you buy.

If a pack reaches you damaged, wrong or faulty, section 9 applies. The details are on the “Returns & Complaints” page. That page forms part of these terms.

Please check your delivery as soon as you receive it. If the packaging is visibly damaged, please take a photo of it straight away. If anything is damaged, wrong, incomplete or not in order, write to us within 5 days at pm@patriterra.ch, with photos of the product, pack and label. Report defects that only become apparent later as soon as you discover them.

In the event of a defect, we will send you a replacement free of charge. If that is not possible, we will refund the purchase price.

The following are not defects:

• slight differences in the shape and size of the handmade truffles
• a whitish coating on the chocolate (chocolate bloom) that forms after delivery due to heat or temperature fluctuations; it is harmless and only affects the appearance
• changes caused by incorrect storage or after the best-before date has passed

Monfortelli make a lovely gift for employees and customers. For companies, associations and other organisations, the following also applies:

• Quotation: For larger quantities and deliveries to several recipients, we will be happy to send you a quotation. We are glad to discuss greeting cards, company logos or volume discounts with you individually.
• Several recipients: If you have orders delivered to several addresses, you provide us with the addresses on self-adhesive address labels. You are responsible for the addresses being correct; you confirm that you are permitted to pass on the addresses for this purpose. We charge shipping costs per delivery address (section 5).
• Inspection: The goods must be inspected immediately upon receipt, and defects must be reported immediately.
• Liability: In the event of a defect, we deliver a replacement or credit the amount. Any further claims are excluded to the extent permitted by law.

Store the truffles in a cool, dry place, away from light and heat. They taste best at room temperature. The instructions on our website and on the packaging are authoritative.

We are fully liable for damage we cause intentionally or through gross negligence, for personal injury and under the Product Liability Act. We are not liable for slight negligence, indirect damage or consequential damage, to the extent permitted by law.

Please note the information on ingredients and allergens. If you give Monfortelli as a gift, please also pass this information on to the recipient.

How we handle your data is set out in our privacy policy.

Swiss law applies exclusively. The United Nations Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is excluded. The place of jurisdiction is Bern. As a consumer, you may also bring proceedings at your place of residence; this right remains yours.

If any provision of these terms is invalid, the remaining provisions remain valid. We may amend these terms at any time for future orders.
